Subscription Policies

General Terms and Conditions (GTC) fivereasons.eu

Trust is the basis of every good partnership. Trust comes from honesty and openness. That is why we have summarized all the important information and agreements that apply to orders in our online shop for you. Please read the following General Terms and Conditions carefully.

§ 1 Provider and Scope

These terms and conditions apply to all orders placed in the online shop fivereasons.eu of Fivereasons SIA, Malu 30, Riga, Latvia, LV-1058

The range of goods in our online shop is only aimed at consumers over the age of 18.

The contract language is English. The law of the Republic of Latvia applies exclusively.

You can access and print out the currently valid General Terms and Conditions on our website fivereasons.eu/de.

§ 2 Conclusion of contract

The range of goods presented on our website does not yet represent a binding application on our part to conclude a purchase contract, but merely an offer to order goods in the online shop. With the click of the button

"Pay now" you submit your binding offer to purchase the selected goods. On the following page you will see the order confirmation. The order confirmation shows your order as it entered our system. You can then print out the order confirmation, save it as a PDF and/or have it sent to you by email. You then have the option of selecting another product and submitting another binding offer to purchase the additional product by clicking on "YES, buy". You must also expressly agree to our general terms and conditions for the additional product. The additional product will then be added to the order confirmation. After selecting the additional product, you then also have the option of viewing the supplemented order confirmation, printing it out, saving it as a PDF and/or having it sent to you.

The purchase contract is only concluded when we either declare an express acceptance of your purchase offer or when we have sent the goods to you without an express declaration of acceptance.

The order data is saved by us.


§ 3 Subscriptions, Cancellation

If you have ordered a subscription or monthly delivery, this runs indefinitely. As a subscribed customer, you have the ability to customize the flavours of your smoothies each month. Additionally, you can snooze your subscription so that you are fully flexible on the delivery dates. If you decide to canel your subscription, you can terminate the subscription at any time in text form (e.g. by email, letter or similar), in which case you can contact us by mail or e-mail:

 Another option to cancel your subscription is on our customer portal, by following these steps:
1. Visit our customer portal at https://fivereasons.eu/pages/customer-portal
2. Log in to your account using your username and password. (if you have not yet created an account, please do so using the same e-mail address that you entered when you made your first order)
3. Once you are logged in, click on the “Subscription settings” tab in the menu bar.
4. If you still are sure that you would like to cancel, then click on the “Cancel subscription” button.

. We must receive the notice of termination. You may be required to provide evidence of receipt of the notice of termination.

Please note that canceling your subscription will take place with immediate effect. If you have a shipment due for shipping within the next 48 hours the order will not be canceled and still be shipped. If you have any further questions or concerns, please contact our customer support team for assistance at support@fivereasons.eu.

§ 4 Prices, shipping costs

The prices stated on the website at the time of the order apply. These prices include the statutory value-added tax at the applicable rate.

You will not be charged for shipping costs.

§ 5 Payment, Default, Consequences of Default

Auto Renewal Terms

If you place an order online or over the phone as part of our subscription, your membership in the program will continue until terminated. If you sign up for an automatic subscription on the Site in connection with your purchase, the payment card you provide will be charged the amount specified on the Site for the product you purchased, and your credit card will be automatically billed every thirty (30) days thereafter for the same monthly amount.

If you are a member of our subscription program and have provided us with a valid credit card number or an alternative payment method, each shipment will be automatically processed at the time of each subsequent shipment or installment payment and processed with the payment method that you have used at the time of your first purchase and registration 

If you wish to cancel your subscription, please read the Section “§ 3 Subscriptions, Cancellation” of these Terms. 

You are required to provide current, complete, and accurate information for your billing account. You are responsible for promptly updating all information to keep your billing account current, complete, and accurate (e.g., change in billing address, credit card number, or credit card expiration date). You must notify us immediately if your credit card information is deleted or invalid. Changes to this information can be made by reaching out to our customer support email support@fivereasons.eu.

Section 6 Offsetting

You can only offset a counterclaim if this counterclaim is undisputed or has been legally established.

§ 7 Delivery, retention of title

We deliver to the address that you specified on the online order page. The goods remain our property until the purchase price has been paid in full.

§ 8 Cancellation Policy

If you are a private individual and the purchase is made for a purpose that is predominantly neither commercial nor self-employed, you have a right of withdrawal according to the following provisions.

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days 

in the case of a contract of sale, from the day on which you or a third party other than the carrier and designated by you take possession of the goods

in the case of a delivery of several goods within a single order, from the day on which you or a third party named by you who is not the carrier took possession of the last goods

in the case of a contract for the regular delivery of goods over a specified period of time, from the day on which you or a third party designated by you, who is not the carrier, takes possession of the first goods.

In order to exercise your right of withdrawal, you must inform FiveReasons:

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you revoke this contract, we will pay you all payments that we have received from you, immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal does not apply to the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

Therefore, please avoid any damage to the seal or opening of the package and any contamination.

Please return the goods in the original packaging if possible. Please inform us before returning to announce the return and to enable us a smooth assignment. The fulfillment of this request is irrelevant for the effectiveness of the exercised revocation.

§ 9 Damage in transit

If you receive the goods damaged, please complain to the deliverer immediately and inform us immediately about the damage. If you do not complain immediately and do not inform us immediately, this has no effect on the warranty rights to which you are entitled.

Section 10 Liability

In the case of intent and gross negligence, we are liable without limitation and in accordance with the Product Liability Act.

In the case of slight negligence, we are only liable in the event of a breach of an essential contractual obligation. An essential contractual obligation is an obligation which must be complied with for the execution of the contract and which you can trust to be complied with. Liability is limited to the amount of damage typically foreseeable at the time the contract was concluded. This limitation of liability applies to the liability of our vicarious agents. The limitation of liability does not apply to damage resulting from injury to life, limb or health of persons.

§ 11 Miscellaneous

Should one or more provisions of these General Terms and Conditions be or become ineffective, the validity of the remaining General Terms and Conditions shall not be affected.
